Horry County Council Embarrassment Continues

A discussion during last week’s Horry County Council Budget Retreat, about county council hiring its own attorney to represent council only, highlighted the deep rift that continues to plague and embarrass council as long as administrator Chris Eldridge is allowed to remain in his county position.

Council member Al Allen introduced the idea of council hiring an attorney to represent council as a body after referring to actions by county attorney Arrigo Carotti in what now appears to have been a civil conspiracy to keep Chairman Johnny Gardner from taking office.

Carotti authored a five-page memo based entirely on his recollection and interpretation of one or more conversations he had with economic development officials weeks before. The memo described actions and statements that never occurred in attempting to weave a narrative implicating Gardner in possibly illegal actions. In his narrative, Carotti made false statements about other persons in the community, supposedly in connection with Gardner and Barefoot, including yours truly.

The memo was used by Eldridge to request a SLED investigation into Gardner and his business partner Luke Barefoot. Eldridge’s request to SLED was made on the morning of December 20, 2019 after the Carotti memo had been leaked and published by a Columbia media outlet.

After the memo was leaked and published, Myrtle Beach Regional Economic Development Corporation President Sandy Davis, the primary source for the Carotti memo according to Carotti, was quoted in several media stories as calling most of the memo “fabricated.”

Carotti and Eldridge were interviewed by SLED investigators on January 7, 2019. The next day, Carotti sent an email to SLED attempting to influence the direction of the investigation and dictating what conclusions should and should not be drawn from it.

SLED found no evidence of impropriety on the part of Gardner and Barefoot during its investigation and Fifteenth Circuit Solicitor Jimmy Richardson announced there was no evidence of criminal activity.

There was nothing documenting or confirming the allegations made in the Carotti memo. It was nothing but recollections about third party conversations he and/or Eldridge had with Davis and the memo was quickly discredited by Davis to both media and SLED investigators

Negotiations on Eldridge Departure Ongoing, Lawsuits Considered

During the regular meeting of Horry County Council April 2, 2019, Chairman Johnny Gardner informed council members that negotiations regarding the exit of administrator Chris Eldridge are ongoing.

There have been some indications that Eldridge believes he has claims against the county that could result in an exit package of significant dollars.

What Eldridge apparently fails to understand is there are others who have potential claims against him and the apparent conspiracy to defame Gardner and others that began with emails as early as December 12, 2018.

There is no question it is past time for Eldridge to go. Four months have passed since he and attorney Arrigo Carotti began developing a narrative to defame the character and reputation of Gardner.

It has been a month since council deadlocked in a 6-6 vote on a motion to fire Eldridge, allowing him to remain in his position as administrator.

Since that vote, new information has been uncovered through Freedom of Information Act requests that point to a joint effort by Eldridge, Carotti and former chairman Mark Lazarus to develop a narrative that could be brought to SLED for an investigation of Gardner.

Eldridge requested the SLED investigation on December 20, 2018 after Carotti completed a five-page memo containing a narrative for which there were no facts to substantiate the authenticity of the memo’s narrative.

The memo was completed after Lazarus, Eldridge, Carotti and council member Gary Loftus listened on December 19, 2018 to a portion of a recording of a November 30, 2018 lunch meeting between Gardner, Luke Barefoot and Myrtle Beach Regional Economic Development (EDC) officials Sandy Davis and Sherri Steele.

On that recording, Carotti and Eldridge alleged there was evidence of attempted extortion of EDC by Gardner and/or Barefoot.

Will the Deep Six Continue to Allow the Administrator and Attorney to Embarrass Horry County?

A specially called meeting of Horry County Council tonight is scheduled to discuss renewing the contract of county administrator Chris Eldridge, which expires April 21, 2019.

What is really to be discussed here is whether council members expect Chairman Johnny Gardner to continue to have attempt to work with Eldridge and county attorney Arrigo Carotti after those two were unsuccessful in an attempt to smear Gardner even before he took office on January 1, 2019.

Six council members, Harold Worley, Dennis DiSabato, Tyler Servant, Cam Crawford, Gary Loftus and Bill Howard, the Deep Six as I call them, voted against firing county administrator Chris Eldridge on March 5th, after the results of a SLED investigation cleared Gardner of allegations of wrongdoing lodged by Eldridge and county attorney Arrigo Carotti.

Three of them, Worley, DiSabato and Loftus, claimed the results of the SLED investigation did not warrant firing Eldridge. The other three, Crawford, Servant and Howard, didn’t even have the courtesy to explain to the collected citizens viewing the proceedings their reasons for voting as they did.

Gardner said he has no confidence in either Carotti or Eldridge.

“People will never understand how difficult it was for me to remain calm and move forward with the business of the county with those allegations against me,” Gardner said. “But, I knew I didn’t do anything wrong and I trusted in the system, a criminal justice system I have been a part of for over 30 years, to conclude the truth. Now, after a SLED investigation exonerated me of any wrongdoing, I find that the administrator and attorney tried to rig the investigation against me.”

Through emails obtained through Freedom of Information Act requests by media, we know as early as December 12, 2018, Carotti and Eldridge in concert with former chairman Mark Lazarus were constructing a version of conversations, none of which any of the three were part of, in order to allege  wrongdoing by Gardner.

County Attorney Tried to Directly Influence SLED Investigation

New information has surfaced that demonstrates Horry County attorney Arrigo Carotti not only attempted to tell SLED investigators what direction their investigation of Horry County Chairman Johnny Gardner should take but also what conclusions they should and should not draw as a result.

Allegations of extortion against Gardner, began with a five-page memo written by Carotti, from December 14–19, 2018, in concert with input from county administrator Chris Eldridge. The memo also attempted to implicate Luke Barefoot, Donald Smith and myself in this fictitious plot.

Eldridge sent the Carotti memo to SLED December 20, 2018 requesting the agency investigate the allegations, but only after the memo was leaked to and published by a Columbia internet media outlet early in the morning of December 20th.

Eldridge told county council members, during a March 5, 2019 special meeting of council, he sent the memo to SLED only after it was leaked in the media because “he didn’t want to be accused of a cover up.”

Before the results of the SLED investigation were made public, an attorney friend of mine told me his theory on the entire affair was that a civil conspiracy plot had taken place among players who were willing to go to any length to keep Gardner from taking office on January 1, 2019. Are we talking “Deep County” here?

With more and more journalists seeking additional information about the allegations against Gardner through Freedom of Information Act requests and questions of the various people included in this saga, new revelations have come to light in recent days that add significant credence to this theory.

Carotti’s original five-page memo is based completely on hearsay about supposed conversations, none of which Carotti nor Eldridge were party to. In his memo, Carotti states he began writing it on December 14th “as a result of events that have taken place since December 5 as memory fades over time and this debacle is broadening.”

Eldridge and His Band of Followers

It has been one week since six members of Horry County Council blindly followed the lead of administrator Chris Eldridge with the story pitched by Eldridge about how and why he called for a SLED investigation with false allegations against Chairman Johnny Gardner.

Last week’s farce seemed more like River City than Horry County with Eldridge playing the part of Harold Hill.

But that is exactly what happens when council members are unwilling to ask questions of the administrator about his story or give more than a cursory glance at the SLED report and the tape recording at its center.

Prior to a November 30, 2018 lunch meeting between Gardner, Luke Barefoot and Sandy Davis and Sherri Steele of the Myrtle Beach Regional Economic Development Corporation (EDC) Eldridge already had his narrative established of what would be told to SLED 20 days later.

This is obvious from the sworn statements given to SLED investigators by Eldridge and Davis. Almost immediately after the lunch meeting ended, Eldridge peppered Davis with specific questions about Donald Smith, supposed stories that were supposed to be written by me, payments to the Beach Ball Classic and a statement by Eldridge about funneling money to Smith.

Eldridge told SLED Davis was “upset” after the meeting. Davis told SLED the meeting went well and EDC board chairman Neyle Wilson said Davis said the same to him and his interpretation of the meeting was quite the opposite of that of Eldridge.

Nineteen days after the meeting, Eldridge, attorney Arrigo Carotti, council members Mark Lazarus and Gary Loftus, Wilson, Davis, Steele and Fred Richardson of the EDC listened to the portion of the recording of the meeting that was pertinent to Eldridge’s false allegations.

According to Davis and Wilson, Eldridge was the only member of the group that “thought he heard something” on the tape to support his allegations. The others said there was nothing there.

Tomorrow’s Special Council Meeting, Gardner and the People v. DiSabato

Horry County Council will hold a special meeting tomorrow to discuss the SLED report and the part played by Administrator Chris Eldridge in taking false allegations to SLED in order to prompt an investigation of Chairman Johnny Gardner.

It is obvious from the SLED report and lack of evidence of any wrongdoing, Eldridge tried to set up Gardner in order to advance a particular agenda.

What is that agenda? It appears to be to subvert the will of the tens of thousands of voters who put Gardner in office in order to effect much needed change in the way the county was being run.

The agenda includes attempting to guarantee construction of Interstate 73 while ignoring the infrastructure already in place. The recent flooding in three of the last four years demonstrates there is immediate need for improvements and flood mitigation on U.S. 501, S.C. 22 and S.C. 9 as well as needs for improvements on Hwy 90 and Hwy 905.

It includes ignoring the needs for increased staffing for public safety departments while pushing the purchase of $12 million of swamp land for some kind of half-baked wetlands mitigation scheme.

It includes alienating an overwhelming majority of county employees by mistaking the title administrator for dictator.

It includes picking a fight with Treasurer Angie Jones over the addition of one person in her office while costing the county more money in legal fees than would have been spent to fund the position as well as attempting to dictate to other countywide elected officials while only filling an appointed position.

It includes a half-baked scheme to extend the collection of hospitality fees to fund the I-73 project that the cities are in the process of destroying, thereby losing a potential source of revenue that could have benefited the citizens of the entire county by helping fund some of the above mentioned needs.

It includes never taking a serious look at how impact fees could be used in order to keep current residents from having to fund goods and services for new development.

Council Votes to Pay Magistrates Retroactive Raise

Horry County Council voted to pay the county magistrates retroactive to FY 2017 for a pay raise that was voted by council but never instituted.

Council voted a three percent pay raise for all county employees beginning FY 2017. The magistrates also received a 3.5% pay raise from the state budget beginning that year.

Despite being included in the county budget to exclude the county three percent raise for the magistrates.

Council member Al Allen questioned how the county got to the point where the magistrates had to threaten to sue the county in order to receive a pay raise approved by county council.

“The public needs to understand how we got here,” Allen said. “Who made that choice?”

Despite the presence of all senior staff at the meeting, not one had the integrity to step up and say they made the decision.

According to several sources inside county government, administrator Chris Eldridge made the decision to exclude the magistrates from the council approved budget pay raise.

Allen made the point that eliminating the magistrates from the pay raise amounted to an amendment to the county budget not approved by council. It takes a three reading budget amendment ordinance passed by an absolute super majority of council (9 yes votes) to amend the budget once it is approved.

Apparently Eldridge believes he can do it by executive fiat.

The magistrates item was not the only pay issue discussed by council.

At the regular meeting two weeks ago, council members Dennis DiSabato and Cam Crawford requested staff to prepare a study to compare the cost of the current merit raise pay policy of the county to a more standard pay scale for public safety employees, such as the one used in other counties throughout the state and in the military.

Instead, assistant administrator Justin Powell and Eldridge briefed council on a study commissioned to compare Horry County employee compensation with 15 similar counties in the region.

A New Emphasis on Public Safety in Horry County?

Throughout his campaign for election last year, Horry County Council Chairman Johnny Gardner pledged “Public Safety Priority One, Day One.”

By the time Gardner decided to run for chairman last March, county employees in general and public safety personnel in particular were suffering under low pay and demanding working conditions due to understaffing.

These conditions had been allowed to go on under the administration of former chairman Mark Lazarus and county administrator Chris Eldridge. The cry was always that there wasn’t enough money to hire more people or give current employees much in the way of raises.

Recognizing the particular frustrations of public safety employees, the first responders that are most needed when problems arise, Gardner coined his campaign phrase, not as something to say to get elected, but rather as something to do after he was elected.

Now, less than two months into his term of office, it appears that a majority of council members have bought into that philosophy.

Council members Harold Worley and Al Allen,  two of the more senior members of council, have long advocated for better pay and increased staffing for public safety, but they operated as voices in the wilderness as Lazarus, Eldridge and other senior county staff consistently cried ‘no money, no money.’

Current Public Safety Committee Chairman Danny Hardee joined the ‘wilderness chorus’ when he was elected to council two years ago, but it was still only three council members with the remaining nine basically buying into staff propaganda.

However, the situation appeared to change at the regular meeting of council earlier this week when council members Cam Crawford, Dennis DiSabato, Tyler Servant and newly elected Orton Bellamy voiced support for a new study on pay and staffing for public safety personnel.

These are heartening additions as there now is a possibility of at least eight votes supporting proper pay and staffing for public safety.

Insurrection Fizzles, Council Meeting Quiet

The threatened insurrection over county council seating, assigned by Chairman Johnny Gardner, fizzled out yesterday when the Gang of Five began falling apart.

According to council sources, one of the first to fall was council member Tyler Servant. Those sources said it was his opposition to a change in dais seating that spurred council member Harold Worley to take up the cause. It seems Servant liked his former seat which put his face on television more than just when he was speaking.

However, by last night Servant was saying in social media he would sit on the floor if asked. More savvy than most of his colleagues about social media, it didn’t take Servant long to discover how childish the public was interpreting complaining about where you sat during meetings.

Worley also backpedaled in traditional media saying he would sit wherever the chairman told him to. That was not the case the day before when Worley was emailing the council clerk and county attorney about having a motion to try and stop the seating change.

One other small bit of friction was the statement by Dennis DiSabato complaining about the chairman’s committee assignments when he didn’t get chairmanship of a committee that he expected. But, council rules place the responsibility of making committee assignments solely to the chairman and any previous discussions are just that, discussions. The chairman has the absolute right to finalize committee and chairmanship assignments as he sees fit for what he determines best suits the county.

A hats off to Gardner for handling both controversies with calm and dignity, not feeling the need to respond publicly to these challenges to his authority. One must remember, he sits on a dais with 10 members of council who supported his opponent and some, obviously, still have to get over the fact that Gardner won.

Public input on several second readings of ordinances demonstrated the public’s view of council responsibilities.

County Council’s Phony Tax Referendum

Horry County Council is expected to have a discussion next week about placing an advisory referendum on the November 2018 general election ballot regarding tax increases for public safety.

The issue was proposed by council member Tyler Servant at last month’s council meeting. Acknowledging the main topic of the primary election which cost council chairman Mark Lazarus nomination to another term in office, Servant said he was opposed to raising taxes but believed the voters should have a say on whether they wanted to pay higher taxes to increase public safety services in the county.

Council members Dennis DiSabato and Cam Crawford jumped on the bandwagon, acknowledging a need for more public safety personnel and facilities in the county but saying the voters should make the decision.

The discussion will be a waste of time as an advisory referendum will not solve the problem of funding for public safety needs. Regardless of how the referendum is worded and what percentage of the vote it may receive, an advisory binds the council to no action and, furthermore, does not provide permission from voters to raise taxes above the limits of Act 388.

The proposal for a discussion and resolution vote to place the advisory referendum on the ballot appears to be an attempt to divert the discussion from various alternatives for public safety funding to a possible tax increase.

Republican chairman nominee Johnny Gardner, who defeated Lazarus in the June primary voting, never mentioned raising taxes while he campaigned on increasing public safety personnel numbers and pay throughout the county.

Gardner said the current 20 ½ minutes average elapsed time it takes from when a 911 call is answered until a first responder arrives on the scene is unacceptable. Gardner pledged to make public safety funding priority one in the budget process.

At times, when extra sources of tax dollars become available, public safety staffing is never on the radar of most council members and county staff.
