Remembering Horry County Council Past Decisions

A small agenda item for Tuesday’s Horry County Council meeting brought reminders of how special interests and ego often combine to replace common sense in the public decision making process.

The item was second reading of an ordinance to make a slight adjustment to the Multi County Business Park ordinance of 1999 as amended in 2000.

Under consideration was abandonment by Horry County of the last several years of an exclusive option to purchase land from Burroughs and Chapin near the Myrtle Beach International Airport.

On the surface it seems like a fairly innocuous item.

Until we remember the MCBP was essentially a $79 million giveaway to B&C for basically nothing in return for the county. It was the most contentious issue of its day, passed three readings by a slim majority, and, within the next few years, 10 members of council either left office or were defeated at the ballot box.

The MCBP ordinance was the ultimate example of local elected officials bowing to the demands of special interests at the expense of ordinary voters and it cost many of them their elected position.

The piece of land in question was needed for construction of a second runway at Myrtle Beach International.

The second runway concept was part of an airport plan of the early 2000’s that included a $500 million airport terminal on the west side of the runways. This was a time when council egos envisioned MBIA as a major gateway airport for national and international tourists that were going to flock to Myrtle Beach.

The concept was absolutely ridiculous and a pure flight of fancy (ego) on the part of a majority of county council for several years until the entire plan fell victim to its own faults.

Council Against Horry County Sheriff Merger

If the decision is left up to the politicians, the Horry County Sheriff merger with the Horry County Police Department won’t happen.

Horry County Council is building a case that it’s too costly and they don’t know who the next sheriff will be.

Restated the case is: the same voters who elected current council members aren’t to be trusted when it comes to electing a sheriff.

The county is also pointing to an approximately $650k price tag to repaint and remark the vehicles and buy such things as new badges and uniforms to replace the current HCPD stock.

I have a quick suggestion. The $650k is approximately the same price as the proposed new mobile command center county council and HCPD want to purchase. Quit with the Inspector Gadget mentality and the money is found.

The amount of public money Horry County Council and HCPD have wasted on gadgets and radios over the last 15 years is abominable. These are two groups who should never use spending public dollars as an excuse not to do something that makes sense, considering the number of things they have spent public money on that do not make sense.

The real issue, however, is what can be done to eliminate the culture of corruption that has existed in HCPD ranks, especially command ranks, over the last two or so decades.

Obviously hiring a new chief is not the answer. Four new chiefs have been hired over that period (two internal, two external) with little to no change.

The decision on whether or not to merge the Sheriff’s department with HCPD is one that the people should decide in a referendum.

And, the argument that we don’t know who will follow our current sheriff Phillip Thompson is bogus. We don’t know who is going to succeed our current council members either.

Final AvCraft Chapter?

The Horry County Transportation Committee voted earlier this week to write off $113,687 in unpaid rent from AvCraft Technical Services that the county will never collect anyway.

AvCraft filed for bankruptcy in March 2015 after an 11 year history of failing to make good on its promises to Horry County.

This should be the final chapter in the saga of local and state politicians, especially Horry County Council, looking at AvCraft through rose colored glasses in the name of economic development.

Since arriving to much hoopla in 2004, AvCraft was consistent in only two areas – it consistently failed to meet job goal promises and it consistently requested and received rent reductions on the three hangars at Myrtle Beach International it rented from the Horry County Department of Airports.

After eight years of failing to meet goals, Horry County Council tried one last time in January 2012 to help AvCraft save itself with the recommendation of the Myrtle Beach Regional Economic Development Corporation.

One of the main items in that agreement was a $1.25 million reduction in rent on the county hangars over a five year period. This came after three earlier rent reductions, agreed to by the county, failed to make AvCraft profitable.

The following four comments made after the 2012 incentive package was approved demonstrate how far from reality politicians and their economic development arms exist from reality:

“I am thankful for the company’s commitment to Horry County and proud of our economic development team for this terrific announcement.” – Rep. Tom Rice.

“It’s another great day in South Carolina, and we are going to celebrate AvCraft’s decision to expand and create 150 new jobs in Horry County.” – Gov. Nikki Haley.

“AvCraft is a tremendous asset to our community, and this project is just the beginning for aviation-related businesses locating and expanding in the Myrtle Beach region.” – Doug Wendel, MBREDC board chairman at the time.

Horry County Sheriff Referendum Appears Dead

It appears that decisions have been made out of the public eye that no referendum will be put to the people on whether to consolidate the Horry County Police Department and Horry County Sheriff’s Department.

An advertisement for applications for the position of police chief was posted recently on the Horry County website.

This would not have been done if there was any chance Horry County Council would vote to authorize a referendum on whether the two departments should be consolidated.

Sources familiar with the views of council members say there are only two votes among council members that would support placing a referendum before the voters.

There appeared to be a majority opinion among county residents that the Sheriff’s Department should take over HCPD in order to fix it. One wonders why county council members are so out of contact with the citizens they represent.

With the decision to forego a referendum and hire a new chief, the responsibility for fixing the many problems at HCPD rests squarely on the shoulders of Horry County Council members.

If the voters approved consolidation of the two departments, something I believe would have happened if a referendum were held, it would have solved another potential problem for Horry County Government that it has strived to ignore through the years.

The problem is one of dual taxation where residents of the various cities within Horry County pay tax millage to fund HCPD while not getting the benefit of police services from the county police.

Fixing the HCPD Culture of Corruption

Having watched portions of a videotaped deposition by former Horry County police detective Allen Large, it is apparent a culture of corruption exists at the HCPD far beyond the actions of a few officers.

Large is being sued by three women, described as Jane Does 1-3 in lawsuits, for sexual harassment, among other allegations.

In his deposition, Large admitted he suggested to three different female victims they get involved in videotaped cat fights to make money and admitted he enjoyed watching such events.

But, Large appeared to feel that his transgressions were minor compared to what other officers, including command staff officers, got involved in.

“We have a lot of incidents of officers doing stuff,” he said in his deposition.

Large went on to list officers having sex with other officers and department employees during duty hours, sometimes on desks in various offices within the police department; officers getting sexual services from exotic dancers while on duty and narcotics officers having sex with informants as some of the types of “stuff” going on.

Large said, “Officers have been let go for sending pictures of their private parts to people they pulled over.”

“There’s a lot of people still working there that have had “relationships” and things like that,” he said.. “Unless the police department’s covering up something, they should be able to tell you who they were.”

“You’re not supposed to be going and having sex while you’re on duty,” but Large said that sort of thing has been going on within the HCPD since he’s been there.

“There’s all kinds of shenanigans that go on there (HCPD) all the time,” Large added.

Large noted one case in which he said he was investigating the death of a man while his partner was “going off and having sex with the victim’s girlfriend.”

Time for Horry County Sheriff Referendum

It is time for the citizens of Horry County to answer a referendum question ‘should all county law enforcement responsibility be turned back to the Horry County Sheriff?’

Unfortunately, this is something that Horry County Council must approve and, if information from a number of sources is accurate, the political will to approve a referendum vote is not a majority view of county council members at present.

Horry County Council members must answer the question, ‘are county citizens better off with the current system, which gives most law enforcement responsibilities to the Horry County Police Department?’

Considering SLED has several ongoing criminal investigations into the HCPD, especially the detective division, as well as several lawsuits already filed against HCPD with more expected to come, the obvious conclusion is a resounding NO!

Much to my surprise Sheriff Phillip Thompson said several days ago that he believed it is time to put the question of whether to recombine the HCPD with the Horry County Sheriff’s Department to the citizens of Horry County.

Thompson said he has received hundreds of calls from county residents over the last several weeks saying it was time for the sheriff’s department to run law enforcement activities within the county.

There are pros and cons to having the departments combined.

At this time, I believe the pros of having the sheriff take over the HCPD far outweigh the cons.

The sheriff is an elected official, directly answerable to the public. With HCPD under Horry County Council, through the administrator, there are too many levels of bureaucracy.

With the current situation, of a citizen has a problem with HCPD he or she inevitably calls his council member, who calls the administrator, who calls the police chief, who calls the captain of the area the complaint is about, who calls the officers involved.

With all those levels of bureaucracy to pass through, the problem often isn’t addressed and may never be solved.

Potential Buyer Looking at PTR Industries

A firm from New York state is reportedly looking at the possibility of buying PTR Industries, a deal that could save the company’s operations at Horry County’s Cool Springs Business Park.

PTR Industries was recruited to relocate from Connecticut to Horry County in 2013 by the Myrtle Beach Regional Development Corporation. This was touted as a major coup by MBREDC as Horry County was a successful bidder over several other states in landing PTR Industries.

A package that included an approximately $1 million upgrade of a county spec building at Cool Springs Business Park and incentive based job creation credits was put together by MBREDC and the SC Department of Commerce for PTR Industries.

The company brought approximately 21 workers with it from Connecticut and promised to create an additional 145 jobs in Horry County within three years.

PTR Industries commenced operations in Horry County in January 2014 and hired approximately 28 additional employees in the first months of its operations.

However, it quickly fell behind in its rent payments to Horry County for the Cool Springs Business Park building that is its headquarters and manufacturing location. One week after a Grand Opening celebration, in July 2014, that included appearances by Gov. Nikki Haley and local Congressman Tom Rice, PTR Industries laid off some workers and instituted a 10% across the board pay cut to those remaining.

Since then, PTR Industries has struggled. According to several sources, Horry County Council restructured its rent deal with PTR Industries last fall in order to help the company become current.

It’s Tax Time Again

Spring means many things, but to local governments it means tax time, or consideration of whether to raise taxes or not.

One year after Horry County Council passed the largest tax increase in county history, the cities of Myrtle Beach and North Myrtle Beach are looking to follow suit.

Both city councils are considering a property tax increase and increases in other fees that could significantly impact citizens and businesses.

To be fair, some of the reasons for the tax increase can be directly attributed to the General Assembly. This can be thought of as an indirect tax on citizens from Columbia.

Two areas come to mind quickly, the refusal of the General Assembly to fully fund the Local Government Fund and the need to make up billions of dollars of shortfall in the public pension funds.

The Local Government Fund is a return of state taxes, which is supposed to reimburse local governments for expenditures on state mandated agencies included in local budgets. The General Assembly, however, prefers to pass annual exemptions in order to underfund this return of tax dollars to local communities.

In this way, the General Assembly can appear to be holding the line on taxes while blaming the local governments for tax increases. Never mind that the state laws requiring these agencies came from the same body that refuses to live up to its mandated level to fund them.

The General Assembly is looking to increase the percentage local governments must contribute, per employee, for all employees included in the various state pension plans. This increase would take the local agency contributions from the current 8.16% of an employee’s annual salary to 11.5% of that salary.

I would submit the increase is needed because the General Assembly has refused to perform its fiduciary oversight responsibilities of the SC Retirement System Investment Commission.

Questions Surround Robert Shelley County Council Candidacy

Robert Shelley, currently a candidate in the special election Republican primary for Horry County Council District 7, may have problems with both state and federal law should he attempt to continue to work for the SC Department of Motor Vehicles if he is elected to the District 7 seat on county council.

According to a Facebook post announcing his candidacy for the open District 7 county council seat, Shelley described his current job which may cause problems for Shelley assuming his seat as a county council member should he win the election.

“In the fall of 2007, I was offered a position with the State of South Carolina Department of Motor Vehicles, Dealer Licensing & Audit Unit as a Dealer Agent. I currently hold the position of Lead Investigator where I supervise the newly formed state-wide investigative unit,” Shelley said.

In a separate Facebook post, Shelley definitively stated he will continue working for the state agency, if elected.

“I have over 35 years of experience working in City, County & State Government and I plan to continue working for the State of South Carolina if I’m elected,” Shelley said on his Facebook page.

There are three potentially significant legal problems for Shelley if he wins the election and attempts to remain in his state job.

The first is the federal Hatch Act. Although it has been amended several times since it was first passed by Congress in 1939, the act still makes it illegal to run for partisan political office for those who hold certain positions within state government agencies that receive funding through federal grants or loans.

According to a spokesman for the SC Department of Motor Vehicles, that agency definitely receives funding from the federal government as part of its budget.

Shelley’s state position may or may not be one of those affected by the Hatch Act, but it certainly should be something he addresses with the voting public.

The next potential problem is with a state law mirroring the Hatch Act for state employees.

Revenues, Expenses and the HCSWA Budget

The HCSWA budget is in its final preparations before being included in the overall Horry County Government budget as it is every year.

While the Horry County Solid Waste Authority budget has been included as a section of the county budget since its inception in the early 1990’s, Horry County Council has paid little to no attention to it when approving its annual fiscal year budget.

This year is different. Some council members are actually paying attention to the HCSWA budget.

That is a good thing. It was prompted by the initial request of the HCSWA for an increase in tipping fees at the county Hwy 90 landfill.

Tipping fees are the cost, ultimately paid by the citizens of the county, of burying waste in the ground.

To its credit, the HCSWA has essentially charged the same tipping fee, with some minor variations, since 1992. To its detriment, for many of those years, the tipping fee charged to the citizens of the county was too high.

I remember one former executive director of the HCSWA commenting over a decade ago that so much money (from tipping fees) was coming into the authority coffers, it didn’t know what to do with it all.

A lot of the excess revenue got wasted on purchases of land that was not needed, public relations campaigns, lobbying fees, attorney fees, even bugs that theoretically would extend the life of the landfill, but, in fact, died.

While some of this sounds funny, millions upon millions of public dollars were wasted by a succession of HCSWA boards and the indifference of county council.

Now, the HCSWA is in somewhat of a cash crunch, somewhere between $500k-$1,000k projected shortfall in the fiscal year beginning July 1, 2016.

The first inclination of the HCSWA staff and board was to raise tipping fees. County council said “NO”.
